Cannabis Farming Bill 2023 Approved By Parliament.
Cannabis Farming Bill: The Narcotics Control Commission Bill, 2023 has been approved and enacted by Parliament.
This approval will authorize the Interior Ministry to grant licenses for the cultivation of cannabis with a utility content of no more than 0.3% on dry weight basis.
These licenses are intended for industrial or medicinal purposes.
This development follows the Supreme Court’s intervention, where section 43 of the law was deemed unconstitutional, thereby obstructing its initial passage.
Section 43 previously granted the Interior Minister the power to issue licenses for the cultivation of a limited quantity of cannabis in Ghana, specifically for industrial and medicinal purposes.
The Supreme Court ruled that since there was no deliberation on this section during the proceedings, it held no legal validity.
Both the Speaker of Parliament, Alban Bagbin, and the Interior Minister, Ambrose Dery, criticized the apex court’s decision.
On Wednesday, July 12, 2023, Parliament amended the law and reintroduced the same provision.
“After no objections were raised, the Speaker declared the Narcotics Bill, 2023 read for the third time and passed,” he announced to the members of Parliament.
